Environment Resources and Development Court Hearings
Further to the Government directives and recommendations regarding the community response to COVID-19, the Environment Resources and Development Court advises that the following arrangements will be effective immediately:
Hearing of Matters
All matters capable of being dealt with by consent orders, or without the need for attendance will, where appropriate, be dealt with in Chambers. Parties should advise the Court as soon as practicable if there is agreement between the parties as to proposed orders.
Parties will be encouraged, where appropriate, to appear by telephone for Conferences, Directions Hearings and Applications.
Parties who are applying for orders to be made by the Court should provide Draft Minutes of Order electronically in word form prior to any listed hearing.
As far as practicable, it is proposed that all hearings will proceed by way of written submissions. This may need to be considered on a case by case basis.
Avoiding attendance at Registries and Filing of Documents
Documents are to be filed with the Environment Resources and Development Court Registry in accordance with the message from the Registrar dated 27 March 2020 (accessible on the CAA Website):
- Wherever practical, to avoid attendance in person at the Environment Resources and Development Court Registry, all documents presented in the approved form for filing should be presented for filing electronically by email or by registered post.
- Presentation of documents by attendance at the registry should be avoided wherever possible.
- All post can be sent to GPO Box 2465 Adelaide SA 5001.
- Environment Resources and Development Court documents can be sent electronically to: erdcourt@courts.sa.gov.au.
- Documents should be in PDF format and signed unless otherwise requested.
- Documents that are too large for email can be either posted or alternatively a drop box is available in the Sir Samuel Way Building.

General
Any party may, consistent with the current rules and practice, make an application for a matter to be called on before the Court.
These arrangements are to remain in place until further notice.
