If the ERD Court finds against you, you have three weeks or 21 calendar days to appeal to the Supreme Court.  The Supreme Court is:

  • more formal than the ERD Court
  • you can expect the costs to be higher; and
  • if you lose in the Supreme Court you may be ordered to pay the costs (eg: legal fees, witness fees, court fees, etc) of the other party.

We recommend that you get legal advice before taking this step.

If you do decide to go ahead, with or without a lawyer, you will have to pay court fees to file your Supreme Court appeal.

Remember too that if you win in the ERD Court the other party may decide to appeal to the Supreme Court.  Again we recommend that you get some legal advice if that happens.
