The Environment, Resources and Development (ERD) Court is a specialist court set up to deal with disputes, and the enforcement of the laws, that relate to the development and management of land, the natural and built environment and natural resources.
The court’s powers and responsibilities are conferred on it by a wide variety to legislation.
A significant proportion of the cases that come before the court (about 77%) are appeals against decisions made about development applications. Because many of the people who participate in those appeals don’t use lawyers, we have developed a Step by step guide to running an appeal concerning a development application in the ERD Court.
The guide is specifically designed to help self represented litigants involved in appeals against decisions made about development applications. For others, the guide will not be strictly relevant. It may however be useful in that it gives something of the flavour of how the court deals with all matters it hears.
