The judgments and sentencing remarks published here are from the Environment, Resources and Development Court of South Australia.

The State Courts Administration Council has decided to publish these decisions of the Judges and Commissioners of the ERD Court so that members of the public will have access to a complete statement of the judicial officers’ reasons for the decision.

Judgments and sentencing remarks will usually appear on the site the same day as they appear in the public cause list as having been delivered.

Judgments and sentencing remarks may be edited to take account of suppression orders or if the general publication of them is likely to have an adverse impact on witnesses and others connected with the proceedings.

A judge or commissioner may decline to release the judgment or sentencing remarks for publication on the website if the judge or commissioner decides that it is not possible to edit the material appropriately while retaining meaning.
