This is an online version of the Law Handbook – a non lawyer’s guide to law in SA. It has a chapter on local government and planning that includes information about the ERD Court and how it works.
This site will be relevant to you if you are appealing against a development decision. By following the links on this site you can find the Development Plan that is relevant to the development you are supporting or opposing – and read the objectives and principles that govern development in your council area and your zone.
The Local Government Association website provides links to all the local council websites.
Austlii, The Australian legal Information Institute website, is one of the places lawyers go to get information. It has links to all legislation and also carries the decisions of the ERD Court since 1997. The cases are sometimes several months behind and not every decision is reported. The site can be searched using key words. For example, if you search for cases that might support your argument, by searching under council area, zone, type of development and other keywords.
The SA Law Society has an online referral service that can direct you to lawyers who practice in environmental/planning law. It also can tell you about the legal advisory service where you can talk to a lawyer (to get some preliminary advice) for 20 minutes for $15 ($5.50 for pensioners).
