Leave to Appeal to the Full
Court
1. This practice direction applies to leave
to appeal applications to the Full Court which are to be considered without the
attendance of the parties. It is a supplement to the requirements stipulated in
Rule 94.03 of the Supreme Court Rules 1987.
2. In addition to the summary of argument
referred to in Rule 94.03 and the application document (Form 21, Supreme Court
Rules) the applicant must file four copies of the summary of argument and three
copies of the book of documents with the Appeals Officer.
3. The book of documents must contain the
following:
(a) The
application for leave to appeal.
(b) The
sealed order in respect of which leave to appeal is sought.
(c) A
sealed order refusing leave to appeal, if any.
(d) The
reasons given by the Judge for his decision and for refusing leave to appeal,
if any.
Unless
a contrary direction is given by the Court no other documents need be lodged
prior to the Full Court considering the application for leave to appeal.
4. If leave to appeal is granted then the
other requirements of Rule 95.09, 95.10 and Practice Direction No. 13 must be
complied with before the appeal is set down for hearing.
5. The intended appellants will be advised in
writing of the result of the application once the result has been determined by
the Full Court.
