Appeals from the ERDC
If the ERD Court finds against you, you have three weeks or 21 calendar days to appeal to the Supreme Court/Court of Appeal. These Courts are:
- more formal than the ERD Court
- you can expect the costs to be higher; and
- if you lose you may be ordered to pay the costs (e.g. legal fees, witness fees, Court fees, etc) of the other party(ies).
We recommend that you get legal advice before taking this step.
If you do decide to go ahead, with or without a lawyer, you will have to make an application to the relevant Court (see ERDC Act s 30) and pay Court fees to file your appeal.
Remember too that if you win in the ERD Court the other party(ies) may decide to appeal to the Supreme Court. Again, we recommend that you get some legal advice if that happens.
