Civil claims can be made over a number of matters and are typically made for a sum of money owed, or for claims of damage. The court that will hear a claim and the process to be followed will depend on the amount of money or damages being claimed.
While civil claims can be made in the Supreme Court or the District Court regardless of the amount claimed, cost penalties exist if the amount awarded is below a specific amount. This threshold is based on the type of claim being made and the Court in which it is made. The threshold is defined in the Uniform Civil Rules 2020.
