If you are charged with a criminal offence, you can apply for bail. A bail agreement is one in which you make an undertaking to be present through proceedings and to comply with conditions. If you are represented, you can ask your solicitor to lodge the application. If you are unrepresented, you will need to ask the prison or detention centre to access the form. You will then need to fill it out and ask them to forward it to the court. The same applies with an application to vary or revoke a bail agreement or guarantee of bail. Please note that the below instructions only apply to a party that has access to CourtSA.

  • Completed, signed, and scanned FORM 21A (Application for Bail) or
  • Completed, signed, and scanned FORM 21C (Application to Vary or Revoke Bail Agreement) or
  • Completed, signed, and scanned FORM 21D (Application to Vary or Revoke Guarantee of Bail)

There are no fees for applying for bail or to vary or revoke a bail agreement or guarantee of bail.

Steps:

  1. Log in to CourtSA
  2. Click “My Cases” in the top menu and find the case you wish to apply for bail or to vary or revoke bail or a guarantee of bail and click “View Case”
  3. Click on the “Actions” button in blue
  4. Click on “Lodge a Document”
  5. Click on “Bail Application”
  6. Complete the form
  7. Upload the completed form in PDF format. Please see the ‘How to download a court Form and Upload it to CourtSA’ page
  8. Upload Affidavit (optional) or any additional information (optional)
  9. Lodge the application

You will receive an email from CourtSA confirming that your document has been received for review by the court. If it is approved for filing, you will receive an email with information about what happens next. If your document is rejected, you will receive an email explaining why it was rejected.
